01About these terms
MoreGigs is provided by Trivecta Limited, a company registered in England and Wales (“we”, “us”, “our”). Our registered office is 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom, and you can contact us at support@moregigs.online. These terms, together with our Privacy Policy and our Refund & Cancellation Policy, are the whole agreement between you and us about MoreGigs.
By creating an account, connecting a Freelancer account, starting a trial or subscribing, you accept these terms. If you don't accept them, don't use the service.
In these terms:
- a business user is anyone who uses MoreGigs for the purposes of their trade, business, craft or profession, including freelancing;
- a consumer is an individual who uses MoreGigs wholly or mainly for purposes outside their trade, business, craft or profession.
Some parts of these terms apply differently to consumers. Where they do, we say so.
02What these terms never take away
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law doesn't allow us to exclude or limit.
If you're a consumer, nothing in these terms affects your statutory rights, including those under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. Citizens Advice can tell you more about them.
03Who MoreGigs is for
MoreGigs is intended for freelancers acting in the course of their trade or business. If you're in fact a consumer, your statutory rights still apply.
To use MoreGigs:
- you must be at least 18 years old and able to enter into a binding contract;
- you may only connect Freelancer accounts that are your own;
- each MoreGigs login is for one person, and you must not share it;
- everything you tell us, including your name and email address, must be accurate and kept up to date.
04What MoreGigs does
MoreGigs bids on Freelancer.com projects for you, using an access token from your own Freelancer account. With that token we:
- read your public Freelancer profile;
- find new projects that match your skills and the filters you set;
- place bids on them, within the daily and monthly caps you choose;
- check how your bids turn out;
- read your Freelancer message threads and milestones, so we can show your activity and draft replies for you to send yourself.
We never send messages, move money, sign NDAs or retract bids for you. Those always stay your decision, made on Freelancer.
05We're independent of Freelancer.com
MoreGigs is an independent service. It is not affiliated with, endorsed by or sponsored by Freelancer Technology Pty Limited or Freelancer.com. We mention Freelancer only to describe the account our service works with. Freelancer has no responsibility to you for MoreGigs, and we have no say over what Freelancer does.
06Your Freelancer account is your responsibility
You alone are responsible for your Freelancer account, everything in its profile, and your compliance with Freelancer's own terms, policies and bid limits. It's up to you to check that Freelancer allows you to use an automated bidding service, and you accept all the risk of using one with your account.
When you connect a Freelancer account, you authorise us to act through your access token in the ways described in What MoreGigs does, and in no other way. You can withdraw that permission at any time by disconnecting the account in MoreGigs or by revoking the token in your Freelancer settings.
Freelancer may, at any time and whether or not because of MoreGigs, suspend, restrict, limit, ban or close your account, remove or reject bids, charge you fees, or affect your rating, ranking or reputation. We are not responsible or liable for any of that, or for its consequences, including lost bids, income, clients, reviews, reputation or data.
We don't give refunds or credits when bidding is interrupted or stops because of Freelancer (including its rules, systems, changes or downtime), your Freelancer account's status, your account running out of Freelancer bids, or a token that is invalid, expired or revoked.
If you're a consumer, this section doesn't remove your statutory rights where a problem is actually caused by our failure to provide the service with reasonable care and skill.
07Automated, AI-written proposals
Proposals and reply drafts are generated automatically by a third-party AI provider, from your Freelancer profile, the highlights you give us and the project or conversation they're for. They may be inaccurate, incomplete or unsuitable for a particular project or client.
- Bids and proposals are sent in your name, from your Freelancer account. You are responsible for each of them, for their prices, and for anything you agree with clients, as if you had written them yourself.
- Review your activity regularly, including your bid log and your settings, and pause bidding straight away if something isn't right.
- The third-party AI provider may use the content we send it to train and improve its models (see our Privacy Policy), so don't put anything confidential in your highlights.
08Your information and security
- The information you give us, including your highlights and your Freelancer profile, must be true, not misleading, and made up only of facts you're entitled to use. It must not break anyone else's rights, confidentiality or the law.
- You are responsible for keeping your MoreGigs password and your Freelancer token secure, and for everything done under your login. If you think either has been compromised, revoke the token in Freelancer and email support@moregigs.online straight away.
09No guarantee of results
MoreGigs is built to save you time and bring you more client inquiries, but we don't guarantee any number of bids, inquiries, replies, interviews, awarded projects or earnings. Results depend on things we don't control, such as your profile, your prices, how many projects are posted in your skills, what clients decide and how Freelancer works.
Any numbers we show you, such as projects posted in your skills or likely bids per day, are estimates and not promises.
10Free trial
- Your free trial lasts 24 hours, covers one Freelancer account, and starts when you connect your first account.
- No card is needed for the trial, and nothing is charged when it ends.
- When the trial ends, bidding pauses unless you choose a plan.
- We may end a trial early if it's being misused, for example by the same person starting trial after trial, and we may change or withdraw the trial for new sign-ups at any time.
11Plans, billing and price changes
MoreGigs plans are monthly subscriptions, priced in US dollars and billed through Stripe. At the time of writing they are Starter at US$19, Growth at US$69 and Scale at US$199 a month. Plans differ by how many Freelancer accounts you can connect. The price and limits shown when you subscribe are the ones that apply.
- Your subscription renews automatically each month, and you authorise Stripe to charge your payment method at the start of each period, until you cancel.
- If you switch plans, Stripe prorates the change for the rest of the billing period.
- If a payment fails, bidding pauses until your payment details are updated, and we may suspend your account if the payment isn't made.
- Any currency conversion or card fees charged by your bank are your responsibility.
- We may change our prices. If you already subscribe, we'll email you at least 30 days before a new price applies to you. It then applies from your next billing period, and you can cancel before then if you don't want to continue.
12Cancelling and refunds
You can cancel at any time from the Billing page, which opens Stripe's customer portal. Cancelling stops your subscription from renewing. Your access continues until the end of the period you've paid for, and you won't be charged again.
- Consumers have a legal right to cancel within 14 days of the day their subscription starts. Because you ask us to start the service straight away when you subscribe, we refund your first payment less a proportionate amount for the days you've already used.
- Business users have no statutory right to cancel. Any refund for a business user is at our discretion.
- Otherwise, we don't refund partial months, unused bids, periods affected by Freelancer or by issues on your side, or any payment after we end your account for breach of these terms.
The details, including how to cancel and how refunds are worked out, are in our Refund & Cancellation Policy.
13Acceptable use
You agree not to use MoreGigs:
- to bid on or carry out illegal, fraudulent, deceptive, harmful or abusive work;
- to misrepresent who you are, your skills or your experience;
- with a Freelancer account that isn't yours, or in a way that breaks Freelancer's terms;
- to harass, spam or mislead clients or other people;
- to probe, overload, copy, reverse engineer or get around the security or limits of the service, or to access anyone else's data;
- to resell or share access to the service without our written permission.
14Suspension and termination
You can stop using MoreGigs whenever you like: cancel your plan, disconnect your Freelancer accounts, and email support@moregigs.online if you'd like your account and data deleted.
We may suspend or end your account immediately, and without a refund, if:
- you break these terms, including the acceptable use rules;
- we suspect fraud;
- you raise a chargeback or payment dispute;
- you abuse the service, our team or other people;
- continuing to provide the service to you creates a legal or regulatory risk for us; or
- your use could harm us, other members or the service.
We may also end your account for any other reason by giving you at least 30 days' notice, in which case we refund any time you've paid for and won't get.
If you're a consumer, we'll only end your account immediately and without a refund for a serious or repeated breach, suspected fraud, or where the law requires it. In any other case we'll give you reasonable notice and refund the time you've paid for and won't get.
When your account ends, bidding stops and your access ends. The sections on responsibility, indemnity, liability and governing law continue to apply.
15Changes to the service
We may change, suspend or discontinue any feature, or the whole service, at any time, for example to keep up with changes at Freelancer or our providers, to meet legal requirements or to keep the service secure. We don't promise that MoreGigs will always be available or that any particular feature will continue.
- If we close the whole service, we'll give you at least 30 days' notice where we can and refund any time you've paid for and won't get.
- If a fault in our own systems stops your bidding, email support@moregigs.online within 30 days and we'll credit the affected days to your subscription. For business users, that credit is the only remedy for the interruption.
- If you're a consumer and a change significantly reduces what you've paid for, you can cancel and get a refund for the unused part of your paid period. You also keep your statutory remedies.
16Third-party services
MoreGigs relies on services run by other companies, including Freelancer, Stripe, a third-party AI provider, Cloudflare, our email delivery provider and our hosting provider. We don't control them, and we're not responsible for their availability, what they do or fail to do, or their terms. Your use of Freelancer and your payments through Stripe are also governed by their own terms.
17Your content and ours
The proposals and reply drafts written for you are yours to use. You give us a non-exclusive, worldwide, royalty-free permission to use your profile, highlights and account data to run the service for you and to share them with our providers, as described in our Privacy Policy. The MoreGigs service, website, software and brand belong to us, and you may not copy them.
18No warranties
The service is provided “as is” and “as available”. To the fullest extent the law allows, we exclude all warranties, conditions and other terms that might otherwise be implied by law. We don't warrant that the service will be uninterrupted, error-free or secure, that it will meet your requirements, or that it will keep working with Freelancer.
If you're a consumer, the law requires us to provide the service with reasonable care and skill and as we have described it. This section doesn't affect that.
19Limits on our liability
This section is subject to What these terms never take away. It applies however a claim arises, including in contract, in tort (including negligence) or for breach of statutory duty.
If you're a business user
- We aren't liable for any loss of profit, revenue, earnings, business, contracts, opportunity, goodwill or reputation, for any loss or corruption of data, or for any indirect or consequential loss.
- Our total liability to you is limited to the fees you paid us in the 3 months before the claim arose.
- You must bring any claim within 12 months of when you became aware, or should reasonably have become aware, of the facts it's based on. After that, the claim is barred.
If you're a consumer
- We aren't responsible for losses that weren't foreseeable to both of us when you accepted these terms, or for business losses, such as lost profit, income, contracts or opportunities.
- Our total liability to you is limited to the fees you paid us in the 3 months before the claim arose. This cap won't stop you recovering the price you paid for the affected service, or anything else the law says we can't limit.
20Claims against us caused by you
If you're a business user, you agree to indemnify us, our directors and our staff against all claims, losses, damages, fines, penalties, costs and expenses (including reasonable legal costs) arising from:
- your Freelancer account, or your dealings with clients;
- your breach of these terms, or of Freelancer's terms;
- the content you provide, including your profile, highlights and messages;
- your misuse of the service.
If you're a consumer, you're responsible only for losses we suffer that are caused by your breach of these terms and that were reasonably foreseeable.
21Events outside our control
We aren't liable for any delay or failure caused by events outside our reasonable control. These include failures of, or changes made by, Freelancer, Stripe, the third-party AI provider or our hosting, network or email providers, internet or power failures, cyber attacks, government action, war, epidemics, natural disasters and industrial action. If such an event stops the service for more than 30 days in a row, either of us can end the subscription, and we refund any time you've paid for and won't get.
22Changes to these terms
We may change these terms, for example to reflect changes in the law, in the service or at Freelancer. We'll update the date at the top of this page. If a change is significant and you already subscribe, we'll email you at least 30 days before it takes effect, unless we have to make it sooner for legal or security reasons. If you don't agree with the change, you can cancel before it takes effect. If you keep using MoreGigs after that, the new terms apply.
23General legal terms
- Transfer. We may transfer our rights and obligations under these terms to another organisation, for example if our business is sold. We'll tell you, and if you're a consumer it won't reduce your rights. You may not transfer your rights or obligations without our written consent.
- Entire agreement. These terms, the Privacy Policy and the Refund & Cancellation Policy are the whole agreement between us, and you confirm you haven't relied on any statement that isn't in them. This doesn't limit liability for fraudulent misrepresentation, or, for consumers, for information about the service that the law treats as part of the contract.
- Severability. If a court decides that any part of these terms is invalid or unenforceable, the rest stays in force.
- No waiver. If we delay or don't enforce a right, we can still enforce it later.
- Third parties. No one else has any right under the Contracts (Rights of Third Parties) Act 1999 to enforce these terms, except that our directors and staff may rely on Claims against us caused by you.
- Notices. We'll contact you at the email address on your account. You can contact us at support@moregigs.online.
24Governing law and disputes
These terms, and any dispute about them or the service, are governed by the law of England and Wales.
- If you're a business user, you agree that the courts of England and Wales have exclusive jurisdiction.
- If you're a consumer, you can bring a claim in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in your local courts.
Before going to court, please email support@moregigs.online so we can try to sort it out together.
